Fortum’s Data Notice
This data notice (“Data Notice”) relates to the agreement (“Agreement”) between Fortum (Fortum Corporation and its subsidiaries, “Fortum” or “we”) and you ( “you”) and applies when you use our products and services that are within the scope of Regulation (EU) 2854/2023 (“Data Act”). This Data Notice gives you the pre-contract information that is required under the Data Act. The following pre-contract information will apply unless otherwise set out in the Agreement or applicable data descriptions.
All the capitalized definitions shall have the same meaning as defined in Data Act.
Connected Product or Related Service data may be generated when you use our provided Connected Products or Related Services. Product and service specific information about the type, estimated volume, and collection frequency of the data, storage policies and Data Holder’s identification information may be found in the applicable data descriptions.
Connected Product and Related Service data is stored for as long as it is necessary for: i) the provision of the Connected Product and/or Related Service, ii) product and service development, or iii) complying with statutory retention periods.
Fortum may use the Readily Available Data for the following purposes:
- performing the Agreement, including all related administrative, support, invoicing and operational activities; and
- developing and improving products and services and other internal business purposes.
The above is only applicable if it has not been agreed otherwise in the Agreement.
This section describes how you can get access to the Readily Available Data and metadata that you cannot access directly from the Connected Product or Related Service. Fortum has a centralized portal through which you can contact Fortum or request access to the Readily Available Data. Request for data access can be made through Fortum’s portal available at: https://www.fortum.com/legal/privacy/contact-fortum-privacy-office. Specific access methods for accessing Connected Product or Related Service data may also be available, if so indicated in applicable data descriptions, Agreement or its related documentation.
In the portal you may also request Fortum to make the Readily Available Data and metadata available to a third party indicated by you. In such case, we have the right to enter into a separate agreement with such third party. You may also request Fortum to stop sharing the Readily Available Data to a third party by submitting a request through Fortum’s portal.
To the extent that the Readily Available Data includes personal data, Fortum shall process such data only to the extent and in the manner necessary for the purposes agreed in the Agreement, in full compliance with Regulation (EU) 2016/679 (“GDPR”) and any applicable national data-protection rules and in accordance with the data processing agreement entered into between you and Fortum, if applicable.
In case the Readily Available Data which you request Fortum to make available to a third party contains personal data where you are not the data subject, you must indicate to Fortum the legal basis for processing of such personal data and you shall be responsible for processing of such personal data in accordance with the GDPR.
You have the right to lodge a complaint relating to the data to the competent authority in accordance with the Data Act.
Unless otherwise stated in the data description, the Readily Available Data does not contain any trade secrets.
Information about the term and termination may be found from your Agreement with Fortum.
Fortum reserves the right to amend this Data Notice. Possible amendments to the Data Notice will be notified about on our website, or by communicating directly to you.
